The Core and Floor Restore Directory ("Directory") is an online platform that connects consumers with health and wellness professionals, including but not limited to physiotherapists, osteopaths, chiropractors, psychologists, yoga instructors, massage therapists, doulas and private midwives. The Directory provides information about listed businesses, allowing consumers to find and connect with service providers. It also lists Reconnected Birthing™ Practitioners (RBP) who have undertaken Core and Floor Restore's Reconnected Birthing Mentorship. 

These Terms govern your access to and use of the Directory. By using the Directory, you accept and agree to be bound by these Terms, as well as any additional terms that may apply to specific services or features available through the Directory.

Consumer Relationship with Service Providers

1. Independent Relationship: By using the Directory, you understand that your relationship is solely with the business you choose to engage with and the Directory Operator (Core and Floor Restore PTY LTD) is not a party to any agreement or contract between you and the service provider.
2. No Liability for Service Delivery: The Directory Operator does not guarantee the quality, availability or outcomes of any services provided by businesses listed in the Directory, including RBPs. The consumer engages directly with the service provider and assumes full responsibility for verifying the provider's qualifications, services and fees before entering into any agreement.

Use of the Directory

1. Permitted Use: You may access and use the Directory solely for the purpose of finding, researching and connecting with service providers listed within the Directory. You agree not to use the Directory for any unlawful or prohibited purpose.
2. Prohibited Use: You agree not to engage in any conduct that may disrupt, damage or impair the Directory, including using automated tools or systems to scrape, extract or collect data from the Directory without permission.

No Endorsement or Guarantee

1. No Endorsement: The Directory does not endorse or recommend any of the businesses listed within the Directory. Listings are made available for informational purposes only and the Directory Operator does not verify the accuracy of the information provided by the businesses.
2. No Guarantee of Success: By using the Directory, you acknowledge that the inclusion of a business in the Directory does not guarantee that the business will meet your expectations or provide satisfactory services. You are responsible for evaluating the suitability of a service provider before entering into any agreement.

Consumer's Obligations

1. Accuracy of Information: When using the Directory, you agree to provide accurate and truthful information if you contact or inquire about a listed service provider.
2. Verification: You acknowledge that it is your responsibility to verify the credentials, qualifications and suitability of the listed businesses. The Directory Operator is not responsible for any misrepresentation or failure on the part of the service provider.
3. Engagement with Service Providers: You agree that any engagement or contract made with a business listed in the Directory is directly between you and the service provider. You agree to abide by the terms and conditions set by the service provider, including payment, cancellations and service delivery.

Privacy and Data Protection

1. Consumer Data: The Directory Operator collects and processes personal data in accordance with its Privacy Policy. By using the Directory, you consent to the collection, use and disclosure of your personal data as outlined in the Privacy Policy.
2. Third-Party Data: When contacting or engaging with a listed service provider, you may be required to share personal information directly with the service provider. The Directory Operator is not responsible for the handling of your data by third-party service providers.

Payment Terms

1. Free Access to Directory: The Directory is provided free of charge for consumers. You will not be required to pay any fees for using the Directory or for accessing business listings.
2. Payment for Services: All payments for services arranged with a business listed in the Directory are made directly between you and the service provider. The Directory Operator is not responsible for any transactions, payments or financial disputes between you and the service provider.
3. Refunds and Cancellations: Any questions, issues or disputes regarding payment, refunds, or cancellations must be directed to the service provider. The Directory Operator is not responsible for handling or resolving these matters.

Dispute Resolution

1. Consumer Disputes with Service Providers: In the event of a dispute between you and a business listed in the Directory, you agree to resolve the matter directly with the service provider. The Directory Operator is not responsible for mediating or resolving disputes.
2. Mediation and Arbitration: If a dispute arises that cannot be resolved directly with the business, you may consider using mediation or arbitration services; however, the Directory Operator is not responsible for facilitating these processes.

Disclaimer of Warranties and Limitation of Liability

1. No Warranty: The Directory is provided "as is" and "as available" without any warranties, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose or non-infringement.
2. Limitation of Liability: The Directory Operator shall not be liable for any direct, indirect, incidental, special or consequential damages arising out of or in connection with your use of the Directory or the services provided by businesses listed in the Directory.

Intellectual Property

1. Directory Content: All content, trademarks, logos and materials on the Directory, including text, images, graphics, and software, are the property of the Directory Operator and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Directory for personal, non-commercial purposes.
2. Business Content: Businesses listed in the Directory retain ownership of their submitted content, including business names, logos, and descriptions. By submitting content to the Directory, businesses grant the Directory Operator a non-exclusive, royalty-free license to display, distribute, and promote their content as part of the Directory.

Amendments to Terms and Conditions

1. Right to Modify: The Directory Operator reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Directory website. You are encouraged to review these Terms periodically to stay informed about updates.
2. Continued Use: By continuing to use the Directory after any modifications to these Terms, you agree to be bound by the revised Terms.

Indemnification

1. Indemnity by Consumer: You agree to indemnify, defend and hold harmless the Directory Operator, its affiliates, employees, agents and representatives from and against any claims, liabilities, damages, losses, or expenses arising from:

4. Any breach of these Terms by you, including any unauthorised use of the Directory's content or intellectual property.

Force Majeure

Force Majeure Event: The Directory Operator will not be liable for any failure or delay in performance of its obligations under these Terms due to events beyond its reasonable control, including but not limited to acts of nature (e.g., floods, earthquakes, fires), government actions, technical failures, or third-party service disruptions.

Third-Party Links and Content

1. External Links: The Directory may contain links to third-party websites or resources. These links are provided solely for convenience. The Directory Operator does not endorse, control, or take responsibility for the content, privacy policies, or practices of third-party websites. You access such links at your own risk.
2. Third-Party Content: The Directory may display content from third parties, including service providers' listings and advertisements. The Directory Operator is not responsible for the accuracy or reliability of such third-party content.

Prohibited Conduct

Consent to Electronic Communication: By using the Directory, you consent to receive electronic communications from the Directory Operator, including notifications about updates to the Directory, changes in these Terms, and other relevant information. Communications may be made via email, notices on the Directory's website, or other electronic means.

Access and Termination

1. Right to Access: The Directory Operator reserves the right to suspend or terminate access to the Directory at its sole discretion if you violate these Terms or engage in conduct that is harmful to the Directory or its users.
2. Termination of Access: You can terminate your access to the Directory at any time by ceasing to use the Directory. However, this does not absolve you of any obligations or liabilities incurred before the termination.
3. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Queensland.. Any disputes arising from the use of the Directory or these Terms shall be subject to the exclusive jurisdiction of the courts in Queensland.
